Importance of Body-Worn Cameras in Police Actions
In recent discussions, the decision made by Justice Barroso regarding body-worn cameras has been described as ‘balanced’ by Tarcísio. The Public Ministry of São Paulo sees no issues with the bidding process for cameras worn by the military police of São Paulo. Additionally, the Federal Public Ministry has initiated a procedure to oversee the allocation of funds for body-mounted cameras on police officers.
In a portion of the cases reviewed, where the content of the footage was analyzed, the Public Defender’s Office observed instances of removal of the camera from the uniform and obstruction of the device during interactions. It was noted that the continuous recording of police actions is crucial, without relying on manual activation by the security agent. Among the identified cases, there were reports of physical assaults by police officers, including kicks and punches. Some encounters had their filming compromised as the body-worn camera was left in the patrol car.
One incident, however, served to verify the regularity of the approach after a detainee claimed to have been assaulted by the police during a custody hearing. Routine and intentional footage Currently, the wearable cameras used by the Military Police of São Paulo record continuously from the moment they are attached to the officers’ uniforms. The footage is recorded in low resolution. For every ‘police-relevant event,’ such as responding to incidents, arrests, or pursuits, the officer must activate the intentional recording mode. In this mode, the footage is captured in higher quality, including sound.
The recording format of body-worn cameras is at the center of the controversy surrounding the bidding process for the purchase of 12 thousand new body-worn cameras for the police, launched by the administration of Governor Tarcísio de Freitas (Republicanos). On Monday (10), the Supreme Federal Court (STF) rejected a request from the Public Defender’s Office of São Paulo to suspend the bidding process. According to the rules, the purchased devices will have an ‘on/off’ function, where it is up to the officer or the PM Operations Center to activate or deactivate the camera. Motorola emerged as the winner of the competition.
According to the São Paulo State Public Security Secretariat, most recordings stored in the current model are routine videos that do not constitute ‘police-relevant records.’ The Secretary of the department, Guilherme Derrite, stated that 97% of the recorded and stored videos were not relevant for police investigations or criminal proceedings. Recordings in practice Overall, the Public Defender’s Office identified, through sampling, 96 cases of individuals arrested who underwent custody hearings in the city of São Paulo, between January 10 and June 3, where they requested access to police camera footage. Out of the 56 requests for footage that were not fulfilled, in the remaining 40 cases, half of them (20 cases) did not have intentional recording activated, and the analysis of the incident was based solely on routine recording (with lower image quality and no audio). The review of the available footage revealed the significance of maintaining a consistent and intentional increase in the use of body-worn cameras to ensure transparency and accountability in police actions.
